ResteGo Terms of Service

These Terms of Service govern access to and use of the ResteGo mobile application and its related features, content, and services.

ResteGo is owned and operated by Yaroslav Imshenetsky, a sole proprietor based in New Jersey, United States. References to “ResteGo,” “we,” “us,” or “our” mean Yaroslav Imshenetsky, operating under the ResteGo name. References to “you” or “your” mean the person accessing or using ResteGo.

By downloading, accessing, creating an account for, or using ResteGo, you agree to be bound by these Terms of Service and the ResteGo Privacy Policy. You must not use ResteGo if you do not agree to these Terms.

1. Eligibility

1.1 You must be at least 13 years old to create an account or use ResteGo.

1.2 ResteGo is not directed to children under 13 years of age. We do not knowingly permit children under 13 to create accounts or submit personal information through the application.

1.3 By using ResteGo, you represent that you meet the applicable age requirement and have the legal capacity to enter into these Terms.

1.4 A parent or legal guardian who permits a minor aged 13 or older to use ResteGo is responsible for supervising that minor’s use of the application.

2. Description of ResteGo

2.1 ResteGo is a crowd-sourced restroom-finding and rating application designed to help users:

(a) locate restrooms;

(b) view restroom information and structured ratings;

(c) submit cleanliness ratings and predefined condition tags;

(d) report whether a restroom appears to be open or closed;

(e) view available facility attributes;

(f) identify restrooms near a permitted device location;

(g) search for starting points and destinations; and

(h) plan potential restroom stops along a route.

2.2 User contributions are limited to structured information, including numerical ratings, predefined tags, facility attributes, and open or closed reports. ResteGo does not provide a feature for free-text reviews, user-uploaded photographs, or camera access.

2.3 ResteGo does not provide turn-by-turn navigation. Selecting a navigation option may transfer a destination to Google Maps, Waze, or another supported third-party navigation application.

2.4 ResteGo is currently provided free of charge and does not include advertising, subscriptions, or in-app purchases.

2.5 Availability of any feature may depend on your device, operating system, location permissions, network connection, third-party services, and geographic coverage.

3. Accounts and Authentication

3.1 Certain ResteGo features require an account. Account registration may be completed through Google Sign-In or an email address and password processed through Google Firebase Authentication.

3.2 You must provide accurate account information and keep it reasonably current.

3.3 You are responsible for:

(a) maintaining the confidentiality and security of your login credentials;

(b) restricting unauthorized access to your device and account;

(c) all activity conducted through your account, except where caused directly by our failure to apply reasonable security measures; and

(d) notifying us promptly if you believe that your account has been accessed or used without authorization.

3.4 You must not create an account using another person’s identity or email address without authorization.

3.5 Passwords are processed by Google Firebase Authentication. ResteGo does not receive or independently store your password.

3.6 We may require reasonable verification before processing an account-related request or restoring access to an account.

3.7 You may delete your account through the account-deletion function available within ResteGo, through the account-deletion webpage at https://restego.app/delete-account, or by contacting us at restegoapp@gmail.com.

4. License to Use ResteGo

4.1 Subject to your continued compliance with these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable license to download and use ResteGo on a compatible device for lawful, personal, and non-commercial purposes.

4.2 No ownership interest in ResteGo or its underlying technology is transferred to you.

4.3 The license granted under clause 4.1 automatically ends when:

(a) you cease using ResteGo;

(b) your account is terminated;

(c) we discontinue ResteGo; or

(d) you materially breach these Terms.

4.4 Any rights not expressly granted under these Terms are reserved by us and our licensors.

5. User Contributions

5.1 “User Contributions” means restroom ratings, predefined tags, facility attributes, open or closed reports, and other structured information submitted through ResteGo.

5.2 You may submit User Contributions only where they:

(a) reflect your honest and good-faith assessment;

(b) are based on your own recent observation or experience;

(c) relate to the correct restroom or location;

(d) do not deliberately misrepresent availability, accessibility, cleanliness, facilities, or operating status;

(e) do not infringe another person’s rights; and

(f) comply with applicable law and these Terms.

5.3 Restroom conditions and operating status can change quickly. You should submit an open or closed report only when you have a reasonable basis for believing that the report is accurate at the time of submission.

5.4 You remain responsible for User Contributions submitted through your account.

5.5 User Contributions are displayed without your name or email address. Other users may see the rating, selected tags, reported attributes, or reported status, but not the identity associated with the submitting account.

5.6 We do not guarantee that every User Contribution will be published, retained, displayed, or incorporated into an aggregate score.

6. License for User Contributions

6.1 You retain any rights that you may hold in your User Contributions.

6.2 By submitting a User Contribution, you grant us a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, store, reproduce, process, aggregate, adapt, display, distribute, and otherwise use that contribution for the operation, maintenance, security, improvement, and promotion of ResteGo.

6.3 The license under clause 6.2 includes the right to:

(a) combine your contribution with contributions from other users;

(b) calculate and display restroom scores and attributes;

(c) correct formatting or technical errors;

(d) remove duplicate or unreliable submissions;

(e) retain contributions after account deletion where they have been anonymized and can no longer reasonably be linked to you; and

(f) provide aggregated or anonymized restroom information to users.

6.4 You represent that you have the right to grant the license described in this section.

6.5 No compensation is payable for User Contributions.

7. Moderation and Information Integrity

7.1 We may review, suppress, correct, aggregate, reject, or remove User Contributions where we reasonably believe that they are:

(a) inaccurate, outdated, duplicated, or misleading;

(b) submitted to manipulate a restroom’s score or status;

(c) generated through automated or coordinated activity;

(d) associated with abusive use of ResteGo;

(e) inconsistent with available information; or

(f) contrary to these Terms or applicable law.

7.2 We may temporarily restrict contribution features while investigating suspected abuse, manipulation, security incidents, or technical faults.

7.3 Moderation decisions may be made through automated checks, manual review, or a combination of both.

7.4 Publication of a User Contribution does not mean that we have independently verified, approved, or endorsed it.

7.5 You may report a User Contribution that you reasonably believe is inaccurate, manipulated, abusive, or otherwise improper through the reporting function available within ResteGo or by emailing restegoapp@gmail.com. We may review the reported contribution and take any action permitted under these Terms.

8. Prohibited Conduct

8.1 You must not use ResteGo to:

(a) submit knowingly false, fraudulent, fabricated, or misleading information;

(b) manipulate ratings, scores, tags, facility attributes, or open or closed reports;

(c) coordinate mass submissions intended to distort restroom information;

(d) create multiple accounts to evade restrictions or influence displayed information;

(e) impersonate another person or falsely claim an affiliation;

(f) access another user’s account without authorization;

(g) collect or attempt to collect information about other users;

(h) scrape, harvest, copy, extract, index, or systematically reproduce ResteGo data without our written authorization;

(i) use bots, scripts, crawlers, automated devices, or similar methods to access or interact with ResteGo;

(j) reverse engineer, decompile, disassemble, decode, or attempt to derive the source code of ResteGo, except where applicable law expressly permits such activity;

(k) bypass, disable, interfere with, or circumvent security or access-control measures;

(l) introduce malware, malicious code, corrupted data, or harmful components;

(m) overload, disrupt, damage, or impair ResteGo or its supporting systems;

(n) test the vulnerability of any system without authorization;

(o) use ResteGo for unlawful surveillance, harassment, discrimination, or harmful conduct;

(p) use ResteGo while driving or operating a vehicle in an unsafe or unlawful manner;

(q) commercialize, resell, sublicense, or exploit ResteGo without written permission; or

(r) assist another person in engaging in prohibited conduct.

8.2 We may investigate suspected violations and cooperate with lawful requests from courts, regulators, or law-enforcement authorities.

9. Crowd-Sourced Restroom Information

9.1 Restroom information available through ResteGo may come from users, OpenStreetMap, public datasets, third-party services, or combinations of those sources.

9.2 Crowd-sourced information may be incomplete, inaccurate, duplicated, outdated, or associated with an incorrect location.

9.3 Restroom cleanliness, accessibility, operating hours, entry requirements, amenities, availability, safety, and open or closed status may change without notice.

9.4 ResteGo does not control the businesses, public authorities, property owners, transport providers, or other persons responsible for the premises at which restrooms are located.

9.5 Displaying a restroom does not represent or guarantee that:

(a) public access is permitted;

(b) access is free of charge;

(c) a purchase is not required;

(d) the restroom is open;

(e) the restroom is safe, sanitary, or maintained;

(f) the restroom is suitable for a particular medical, mobility, accessibility, childcare, or personal need;

(g) the restroom complies with applicable accessibility standards;

(h) the displayed location is precise; or

(i) the premises owner has approved or endorsed ResteGo.

9.6 You are responsible for checking signs, opening hours, entry conditions, staff instructions, local rules, and conditions at the premises.

9.7 Access to private property must not be attempted without permission. ResteGo does not grant any right to enter a business, building, parking area, restricted space, or other property.

10. Route Planning and Location Features

10.1 With your device permission, ResteGo may use an approximate or precise device location to show nearby restrooms or establish a starting point for route planning.

10.2 Location access may be denied or withdrawn through your device settings. Certain features may not function properly without location access.

10.3 GPS signals, network conditions, device settings, mapping errors, environmental conditions, and third-party data can affect location accuracy.

10.4 Route information is provided for planning assistance only. ResteGo does not guarantee that a suggested restroom is located directly on a route, can be reached from the indicated road, or will remain available when you arrive.

10.5 ResteGo does not account for every road closure, traffic restriction, construction project, hazard, toll, vehicle limitation, accessibility issue, weather condition, or local rule.

10.6 You remain responsible for selecting a lawful and safe route and for following road signs, traffic laws, official instructions, and the directions provided by any navigation service you choose to use.

11. Safe Use

11.1 You must not interact with ResteGo while driving where doing so would be unsafe or unlawful.

11.2 Route planning, restroom searches, rating submissions, and status reports should be completed while the vehicle is lawfully parked or by a passenger.

11.3 ResteGo is not an emergency, medical, roadside-assistance, accessibility, or public-safety service.

11.4 You must not rely on ResteGo where immediate restroom access is required because of a medical condition, disability, pregnancy, age-related need, or other urgent circumstance.

11.5 Emergency services or an appropriate local authority should be contacted where urgent assistance is required.

12. Third-Party Services

12.1 ResteGo relies on third-party services and infrastructure, including:

(a) Google Firebase Authentication and Firestore;

(b) Google Maps SDK;

(c) Google Play services;

(d) Mapbox;

(e) Google Maps;

(f) Waze; and

(g) OpenStreetMap data.

12.2 Third-party services are operated independently and may collect, process, or receive information according to their own terms and privacy policies.

12.3 Selecting a third-party navigation option leaves the ResteGo environment and opens a separate application or service. We do not control the routes, directions, data collection, availability, security, content, or performance of that third-party service.

12.4 We are not responsible for:

(a) third-party outages, errors, delays, or service changes;

(b) routes or directions generated by another application;

(c) third-party account requirements;

(d) third-party terms, privacy practices, or security measures; or

(e) losses caused solely by your use of a third-party service.

12.5 Your use of Google Play, Google Maps, Waze, Mapbox, or another third-party service remains subject to the terms applicable to that service.

12.6 Restroom location data sourced from OpenStreetMap is attributed to OpenStreetMap contributors and used under the Open Database License.

13. Intellectual Property

13.1 ResteGo, including its software, source code, object code, interface, design, layout, graphics, databases, branding, logos, text, functionality, and original content, is owned by or licensed to Yaroslav Imshenetsky.

13.2 Applicable copyright, trademark, database, trade-secret, and other intellectual-property laws protect ResteGo and its components.

13.3 Third-party maps, data, names, logos, and services remain the property of their respective owners.

13.4 You must not use the ResteGo name, logo, branding, or other proprietary material without prior written permission, except for accurate, non-commercial references that do not suggest endorsement or affiliation.

13.5 Nothing in these Terms grants you ownership of any intellectual-property right belonging to us or a third party.

14. Feedback

14.1 You may voluntarily provide suggestions, ideas, error reports, or other feedback concerning ResteGo.

14.2 By providing feedback, you grant us a worldwide, perpetual, irrevocable, non-exclusive, transferable, sublicensable, and royalty-free right to use, reproduce, adapt, publish, and incorporate that feedback without restriction or compensation.

14.3 Feedback must not contain confidential information belonging to you or another person.

15. Privacy

15.1 Our collection, use, storage, disclosure, and deletion of personal information are governed by the ResteGo Privacy Policy.

15.2 By using ResteGo, you acknowledge that information will be processed as described in the Privacy Policy.

15.3 You are responsible for reviewing the permissions requested by ResteGo and the privacy settings available on your device.

15.4 Location permission is optional. Denying location permission may reduce the functionality of nearby-restroom and route-starting features.

16. Application Availability and Changes

16.1 ResteGo may be modified, updated, suspended, restricted, or discontinued at any time.

16.2 We do not guarantee uninterrupted, error-free, secure, or continuously available access.

16.3 Temporary interruptions may occur because of maintenance, updates, security incidents, network failures, third-party outages, excessive demand, technical errors, or circumstances outside our reasonable control.

16.4 We may add, remove, or change features where reasonably necessary for technical, operational, security, legal, or business reasons.

16.5 Device compatibility may change when operating systems, third-party services, or technical requirements are updated.

16.6 You are responsible for installing available updates and maintaining a compatible device and internet connection.

17. Suspension and Termination

17.1 You may stop using ResteGo and delete your account at any time.

17.2 We may restrict, suspend, or terminate your account or access where we reasonably believe that:

(a) you have breached these Terms;

(b) your account presents a security risk;

(c) your activity threatens the integrity of ratings or reports;

(d) your activity disrupts ResteGo or affects other users;

(e) continued access could expose us, another user, or a third party to legal liability;

(f) suspension is required by law or lawful authority; or

(g) ResteGo or a relevant feature is being discontinued.

17.3 Where reasonably practicable, we may provide notice before termination. Immediate action may be taken where necessary to address fraud, abuse, security risks, unlawful conduct, or material harm.

17.4 Account termination ends your license to use ResteGo.

17.5 Provisions concerning intellectual property, User Contribution licenses, disclaimers, liability, indemnification, governing law, dispute resolution, and general contractual matters survive termination where their nature requires survival.

18. Disclaimer of Warranties

18.1 ResteGo is provided on an “as is” and “as available” basis.

18.2 To the maximum extent permitted by applicable law, we disclaim all express, implied, and statutory warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, reliability, and security.

18.3 We do not warrant that:

(a) restroom information will be accurate, complete, current, or reliable;

(b) a listed restroom will be open, accessible, sanitary, safe, or available;

(c) route information will be accurate or suitable;

(d) ResteGo will operate without interruption, delay, security incident, or error;

(e) defects will be identified or corrected;

(f) ResteGo will meet every user’s needs; or

(g) third-party services will remain available.

18.4 No statement made through ResteGo creates a warranty unless expressly stated in these Terms.

18.5 Some jurisdictions do not permit the exclusion of certain warranties. Any exclusion prohibited by applicable law will not apply to you.

19. Limitation of Liability

19.1 To the maximum extent permitted by applicable law, neither ResteGo nor Yaroslav Imshenetsky will be liable for indirect, incidental, special, exemplary, punitive, or consequential damages.

19.2 The exclusion in clause 19.1 includes loss arising from:

(a) reliance on inaccurate, incomplete, or outdated restroom information;

(b) inability to locate or access a restroom;

(c) closure, restricted access, purchase requirements, or entry refusal;

(d) unsanitary, unsafe, inaccessible, or unsuitable premises;

(e) route errors, delays, detours, traffic incidents, or navigation decisions;

(f) loss of data, account access, opportunity, or anticipated benefit;

(g) interruption or discontinuation of ResteGo;

(h) conduct of another user, business, property owner, or third party;

(i) unauthorized account access not caused by our failure to apply reasonable security measures; or

(j) third-party applications, maps, data, infrastructure, or services.

19.3 To the maximum extent permitted by applicable law, our total aggregate liability arising from or relating to ResteGo or these Terms will not exceed the greater of:

(a) the amount that you paid directly to us for ResteGo during the 12 months preceding the event giving rise to the claim; or

(b) USD 100.

19.4 The limitations in this section apply regardless of the legal theory asserted and even where a remedy fails of its essential purpose.

19.5 No provision excludes or limits liability for fraud, willful misconduct, gross negligence, or another category of liability that cannot lawfully be excluded or limited.

19.6 Rights and remedies that cannot be waived under applicable consumer-protection law remain unaffected.

20. Indemnification

20.1 To the extent permitted by applicable law, you agree to indemnify and hold harmless Yaroslav Imshenetsky and ResteGo from third-party claims, damages, judgments, liabilities, penalties, costs, and reasonable legal fees arising from:

(a) your unlawful use of ResteGo;

(b) your material breach of these Terms;

(c) a User Contribution submitted through your account;

(d) your infringement of another person’s rights;

(e) your manipulation or misuse of restroom information; or

(f) your unauthorized access to or interference with ResteGo.

20.2 Your indemnification obligation does not apply to the extent that a claim results from our fraud, willful misconduct, gross negligence, or breach of applicable law.

20.3 We may assume control of the defense of a claim subject to indemnification. You agree to provide reasonable cooperation and must not settle a claim in a manner that imposes liability or obligations on us without our written consent.

21. Governing Law and Disputes

21.1 These Terms and any dispute arising from or relating to ResteGo are governed by the laws of the State of New Jersey, United States, without regard to conflict-of-laws principles.

21.2 Before commencing formal legal proceedings, you and ResteGo agree to make a reasonable good-faith attempt to resolve the dispute through written communication.

21.3 A dispute notice must describe the relevant facts, the relief requested, and the sender’s contact information. Notices to ResteGo must be sent to restegoapp@gmail.com.

21.4 If a dispute is not resolved informally, the parties consent to the exclusive jurisdiction of the state and federal courts located in New Jersey, except where applicable law gives you a non-waivable right to bring proceedings elsewhere.

21.5 Nothing in these Terms prevents either party from seeking urgent injunctive or equitable relief where necessary to protect accounts, systems, confidential information, intellectual property, or legal rights.

21.6 Mandatory rights available under applicable consumer law are not waived by this section.

22. Changes to These Terms

22.1 We may revise these Terms to reflect changes in ResteGo, applicable law, third-party services, security requirements, or operating practices.

22.2 The “Last Updated” date will be changed when revised Terms are published.

22.3 Where a change materially affects your rights or obligations, reasonable notice may be provided through ResteGo, by email, or through another appropriate method before the change takes effect.

22.4 Continued use of ResteGo after revised Terms become effective constitutes acceptance of the revised Terms.

22.5 You must stop using ResteGo and delete your account if you do not agree to a revised version.

23. Electronic Communications

23.1 By creating an account or contacting us electronically, you consent to receive service-related communications in electronic form.

23.2 Service-related communications may include security alerts, account notices, legal updates, policy changes, support responses, and operational messages.

23.3 ResteGo does not currently use account information for advertising or email-marketing campaigns.

23.4 Electronic notices satisfy any requirement that a communication be provided in writing, to the extent permitted by applicable law.

24. Force Majeure

24.1 We are not responsible for delay, interruption, or failure caused by circumstances beyond our reasonable control, including natural disasters, severe weather, fire, epidemic, war, civil disturbance, government action, utility failure, internet disruption, cyberattack, labor dispute, third-party platform failure, or failure of mapping, hosting, authentication, or database providers.

24.2 Obligations affected by such circumstances will be suspended for the duration of the relevant event to the extent reasonably necessary.

25. General Provisions

25.1 Entire Agreement. These Terms and the ResteGo Privacy Policy constitute the entire agreement between you and us regarding your use of ResteGo.

25.2 Severability. If any provision is held unlawful, invalid, or unenforceable, that provision will be enforced to the greatest extent permitted, and the remaining provisions will continue in effect.

25.3 No Waiver. A failure or delay in enforcing a right does not waive that right.

25.4 Assignment. You may not assign or transfer your rights or obligations under these Terms without our written consent. We may assign these Terms in connection with a transfer, reorganization, sale, or succession of ResteGo, subject to applicable law.

25.5 No Partnership. These Terms do not create an employment, partnership, joint-venture, franchise, fiduciary, or agency relationship between you and us.

25.6 Headings. Headings are included for organization and do not affect the interpretation of these Terms.

25.7 Interpretation. The words “including” and “includes” mean “including without limitation” and “includes without limitation.”

25.8 Third-Party Rights. Except where expressly stated, no person other than you and Yaroslav Imshenetsky has a right to enforce these Terms.
